Terms of service

These Terms of Service ("Terms") are a legal agreement between you and Senithu Software Solutions ("we", "us", "our"), the operator of the YalloTutor app and the website at yallotutor.com, with its registered address at No: 295/A/1, Nedagamuwa, Kotugoda, Sri Lanka, 11390. By creating an account or using YalloTutor, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

1. Eligibility and accounts

You must be at least 18 years old to use YalloTutor. You are responsible for keeping your account credentials secure and for all activity under your account. Accounts are personal to you and may not be shared, sold, or transferred. You agree to provide accurate information and to keep it up to date.

2. The service

YalloTutor provides AI-powered language tutoring, including live voice conversations, lessons, progress tracking, and related features. It is a self-study practice tool designed to help you build everyday spoken Arabic. We may add, change, or remove features over time, and we may set or adjust usage limits to keep the service reliable and affordable.

3. AI-generated content and no professional advice

YalloTutor's tutor is powered by third-party artificial intelligence, including Google's Gemini models. Please understand the following before you rely on anything the tutor says:

• It is generated automatically. Translations, pronunciations, explanations, corrections, and cultural or situational guidance are produced by AI in real time and are not reviewed by a human before you see them. They may be inaccurate, incomplete, outdated, or inappropriate for your specific situation.
• It is not certified instruction. YalloTutor is not an accredited course, does not confer any qualification, certificate, or language-proficiency credential, and is not a substitute for a professional teacher or a certified translator.
• It is not professional advice. The tutor does not provide legal, medical, financial, immigration, or other professional advice. Do not rely on it for high-stakes or official communication (for example, legal, medical, employment, or government matters) without independent verification by a qualified person.
• No guaranteed outcomes. We do not guarantee any particular learning result, level of fluency, exam outcome, or that the tutor's output will be accurate or fit for a particular purpose.

You use AI-generated content at your own discretion and risk.

4. Plans, minutes, and how billing works

YalloTutor is free to download and includes a free tier. Paid plans ("Subscriptions") unlock additional live voice minutes and features. All Subscriptions and any one-time purchases are sold and billed through Google Play, subject to Google Play's terms in addition to these Terms.

• Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, and your Google Play account is charged, unless you cancel before the renewal date.
• Free trial. Paid plans may include a free trial. If you do not cancel before the trial ends, the Subscription converts to a paid plan and you are charged. You may cancel at any time during the trial to avoid being charged.
• Cancellation. You can cancel at any time from the Play Store: Profile → Payments and subscriptions → Subscriptions → YalloTutor. Cancellation stops future renewals; you keep access until the end of the current paid period.
• Minutes. Live voice minutes are allocated per plan with monthly pools and daily limits as described on the pricing page. Unused monthly minutes do not roll over. Purchased top-up minutes do not expire and remain available until used.
• Price changes. We may change plan prices or limits going forward. Changes never reduce what you have already paid for in the current billing period, and Google Play will notify you of price changes where required before they take effect.

5. Digital products and refunds

YalloTutor sells digital products only: subscriptions and one-time minute top-ups, delivered electronically inside the app.

• All purchases are final — no refunds. Because you can try the service for free (a free tier, free minutes, and a free trial on paid plans) and can cancel at any time, all purchases are final and non-refundable, except where a refund is required by Google Play's policies or by mandatory consumer law.
• Access continues until your plan expires. Cancelling a Subscription does not end it immediately — you keep the paid features until the end of the period you have already paid for, after which your account reverts to the free tier. We do not provide partial or pro-rated refunds for the unused part of a period.
• Immediate delivery. Digital products are delivered and usable immediately after purchase. To the extent permitted by law, you agree that any statutory "cooling-off" or withdrawal period ends once delivery and use of the digital product begins.
• Handled by Google Play. All payments and any refunds are processed by Google Play, not by us. See our Refund Policy for how Google Play refunds work.

Nothing in these Terms limits any mandatory statutory rights you may have.

6. Physical goods (if offered)

YalloTutor is currently a digital-only service. If we ever offer physical goods (for example, branded merchandise or printed learning materials), the following applies to those goods only, in addition to any rights you have under mandatory consumer law:

• Return warranty. You may return an unused physical good in its original, resalable condition within 7 days of delivery for a replacement or a refund of the item price.
• Exclusions. The return warranty does not cover damage caused by misuse or normal wear, or items that cannot be returned for hygiene or safety reasons.
• Return shipping. Return shipping costs are your responsibility unless the item arrived damaged, defective, or incorrect.

Digital products (subscriptions and top-ups) are not physical goods and remain governed by the no-refund terms in section 5.

7. Acceptable use

You agree not to:

• Use the service for any unlawful, harmful, or abusive purpose.
• Share your account, automate requests, or attempt to bypass minute metering, usage limits, or security controls.
• Reverse engineer, resell, or attempt to extract or misuse the underlying AI services or our software.
• Upload or transmit content that is illegal, offensive, or infringes others' rights.

We may suspend or terminate accounts that violate these rules or that create risk or cost through abuse.

8. Your content

You retain ownership of content you create or save, such as the phrases you bookmark from a conversation. By using the service, you grant us a limited licence to process that content solely to operate and personalize YalloTutor for you, as described in our Privacy Policy.

9. Intellectual property

YalloTutor, including its software, content, branding, and design, is owned by Senithu Software Solutions and protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive licence to use the app for your own language learning. All rights not expressly granted are reserved.

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that the tutor's output will be accurate or suitable for any particular purpose.

11. Limitation of liability

To the maximum extent permitted by law, Senithu Software Solutions will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, revenue, or profits. Our total liability for any claim arising from or relating to the service is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold Senithu Software Solutions harmless from any claims, losses, or expenses arising from your misuse of the service or your breach of these Terms.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required for legal, security, or operational reasons. On termination, your right to use the service ends, and sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute, except where mandatory consumer protection law in your country of residence provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Continued use of YalloTutor after an update means you accept the revised Terms.

16. Referral programme

YalloTutor may offer an invitation-only referral programme. Where the programme is enabled for your account, the following terms apply:

• Participation is by invitation. We enable and disable referral participation per account at our discretion. Your unique code appears in the app under Account → Invite friends.
• How earnings accrue. When a person you referred makes a payment (a subscription, renewal, or top-up purchased through Google Play), your account accrues a reward equal to 10% of the USD list price of that purchase. Actual charges vary by country; rewards are always calculated on the USD list price.
• Attribution. A referral counts only when the new user enters your code while setting up their profile, before their first payment. One referral code per account; codes cannot be applied retroactively.
• Payouts are made outside the app. We contact you directly to arrange payment of accrued rewards. Payouts may be subject to a minimum threshold of USD 10 and may take up to 60 days to arrange. You are responsible for any taxes on amounts you receive.
• Fair play. Self-referrals, referrals of accounts you control, incentivised or misleading promotion, spam, and any attempt to game the programme are prohibited. We review all accruals before paying and may withhold or void rewards obtained in breach of these terms.
• Changes. We may modify, suspend, or end the programme (including the reward rate) at any time. Accrued, validly earned rewards at the time of a change will be honoured. Rewards are not transferable and cannot be exchanged for service credit.

The referral programme is operated by Senithu Software Solutions and is not sponsored or endorsed by Google.
